1. Definitions
- "Client" refers to the person or entity (Driving Instructor/School) accessing the services.
- "Service" refers to the website design, hosting, and maintenance provided by InstructorSites.com.
- "Website" refers to the digital product created by us for the Client.
2. Services Provided
We agree to provide the Client with a professional driving school website based on one of our themes or a bespoke design. This includes hosting, SSL security certification, and basic technical maintenance as long as the subscription is active.
3. The 30-Day Free Trial
We offer a risk-free 30-day trial period for new Clients.
- No Payment Required: You do not need to provide payment details to start the trial.
- Cancellation: You may cancel at any time within the first 30 days by notifying us via email. If you cancel within this period, you will not be charged.
- Expiry: If you do not wish to continue after 30 days, your website will simply be taken offline.
4. Fees and Payment
Upon the conclusion of the free trial, if you wish to keep your website live, you agree to pay the subscription fee associated with your chosen plan.
- Subscription Plans: Fees are charged monthly in advance (e.g., £28/month or £25/month for specific plans).
- Payment Method: Payments are collected via Direct Debit or recurring card payment.
- Late Payments: Failure to pay the monthly subscription within 7 days of the due date may result in the temporary suspension of your website until the balance is cleared.
5. Cancellations and Termination
You may cancel your subscription at any time.
- Notice Period: We require a minimum of 30 days' notice to cancel your subscription.
- Data Retention: Upon cancellation, your website will be taken offline. We may retain a backup of your data for a short period, but we are not obligated to store it indefinitely.
- Refunds: As our services are pay-as-you-go, we do not offer refunds for partial months used.
6. Intellectual Property
- Client Content: You retain all rights to the text, images, and logos you provide for the website. You grant us a license to use these materials solely for the purpose of creating and hosting your site.
- Our Property: InstructorSites.com retains ownership of the underlying code, theme design, database structures, and server architecture. The Client is granted a non-exclusive license to use the website while the subscription is active.
- Transferability: Should you wish to move your site to another provider, you are entitled to your content (text/images), but the theme design and proprietary code remain the property of InstructorSites.com unless a buyout fee is agreed upon.
7. Client Responsibilities
The Client represents and warrants that:
- All content provided to us is accurate and does not infringe on any third-party copyright or trademark rights.
- You are a certified Driving Instructor (ADI/PDI) operating legally within the UK.
- You will not use the website for any illegal or unauthorized purpose.
8. Limitation of Liability
To the fullest extent permitted by English law, InstructorSites.com shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.
While we aim for 99.9% uptime, we cannot guarantee that the website will be uninterrupted or error-free due to the nature of the internet.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
